Rights and obligations of the Offeror

  1. By accepting the rules and regulations the Offeror represents that:

    1. He conducts business in compliance with the applicable laws, and in particular has the permits, licences and concessions necessary to conduct business as required by law
    2. He has the legal capacity required to enter into an Agreement;
    3. The offer published in the Service is up to date and contains true and fair information concerning the terms and conditions of the provided service;
    4. He is authorised to place the presented material in the Offer, in particular photographs or other multimedia materials
    5. The contact data provided by him, including the telephone number, e-mail address and the address of the registered office are up to date - in the event of a change of these details the Offeror shall be obliged to immediately update them by introducing the appropriate details into the Offeror's Panel and the offers.
  2. In respect of the representations made, the Offeror shall be exclusively liable to the Administrator, Users and third parties.
  3. The Service may collaborate with the Offeror in the process of the preparation of the offer on terms and conditions agreed with him, which includes the translation of such an offer. In the event that the translation differs from the original, the original language version shall prevail.
  4. The Administrator shall have the right to make changes in the content of the offer and to block access to the content of the offer, if the Offeror violates the principles of the correct use of the Service.
  5. The Offeror grants the Administrator a non-exclusive, unlimited, revocable and free-of-charge right to present, publish and otherwise legally use the Offer to the extent he has made it available in the Service and for purposes of providing the services of the Service
  6. The Offeror warrants that his website is materially different from the Service's websites; it is assumed that the Offeror's websites should have a different layout and his logo should clearly differ from the Service Administrator's logo
  7. The Offeror guarantees that the prices of services specified by him in the Offer and increased by the remuneration due to him and agreed with the Administrator shall not exceed the prices presented by the Offeror on his websites or on the websites of other entities via which he also offers his service.
  8. The Administrator shall have the right to demand from the Offeror a reimbursement of the reasonable costs incurred in connection with the Offeror's non-performance of a service
  9. Irrespective of the above provisions, the Service reserves the right to deduct the following costs from the payment made to the Offeror:

    1. the costs incurred in connection with incorrect bank details provided by the Offeror;
    2. the charges connected with additional services performed for the Offeror in accordance with the Price List of Services.
  10. The transfer of funds to the Offeror's bank account shall be made within 24 hours of the time when the provision of the service by the Offeror was to commence, with the exception of a situation where a complaint has been lodged.
  11. If, in consequence of a complaint, the Client is entitled to a full or partial refund of the price for the Offeror's service or the price for the service with the Service's remuneration, the Service shall make a bank transfer to the Client's bank account from which the payment was made.
  12. The Service shall issue an invoice for the Offeror after making a bank transfer in accordance with par. 10.
  13. The transfer of the Offeror's remuneration for a service that has been cancelled by the Client in accordance with the Offeror's Cancellation Policy shall be made within 24 hours of the time when the provision of the service was to commence.
  14. The Service shall make no settlements on weekends and statutory non-working days.
